1. Acceptance of terms

By accessing or using this app (the “Service”), you agree to these Terms & Conditions. If you do not agree, do not use the Service.

2. Entertainment purpose only

The Service is provided for entertainment purposes only.
It is not intended for identification, authentication, biometric analysis, or any other professional, legal, or security‑related use.

3. User content and permissions

  • You may upload photos and other content that you own or are authorized to use (“User Content”).

  • By uploading User Content, you confirm that:

    • You have all rights and permissions needed to use the images in the Service.

    • Your use does not infringe anyone else’s rights, including privacy, publicity, trademark, or copyright.

  • You remain the owner of your User Content.

4. Generated images and data retention

  • The Service may generate images by combining or modifying faces and historical photos (“Generated Images”).

  • Generated Images are processed automatically and are not intended to represent real events or real historical facts.

  • Generated Images and the underlying face data are deleted after processing and are not stored, cataloged, or used to build user profiles, to train models, or for any other secondary purpose.

  • You are responsible for downloading or saving any Generated Images you wish to keep before closing or leaving the session.

5. Acceptable use

You agree that you will NOT use the Service to:

  • Violate any law or regulation.

  • Harass, threaten, defame, or abuse any person or group.

  • Create or distribute content that is hateful, discriminatory, sexually explicit involving minors, or otherwise harmful.

  • Mislead others, including by implying that Generated Images are real historical photographs or official records.

  • Infringe any third party’s rights, including rights of privacy and publicity.

Top Speed AI, LLC may suspend or terminate access to the Service for any misuse or suspected misuse.

6. No warranties

The Service is provided “AS IS” and “AS AVAILABLE,” without any warranties or representations of any kind, whether express or implied.
Top Speed AI, LLC disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non‑infringement, and accuracy of results.

7. Limitation of liability

To the maximum extent permitted by law:

  • Top Speed AI, LLC and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your use of the Service.

  • The total aggregate liability of Top Speed AI, LLC for any claim related to the Service will not exceed the amount you paid (if any) for access to the Service in the 3 months before the claim arose.
    Some jurisdictions do not allow certain limitations; in that case, the limitation will apply to the fullest extent permitted by law.

8. Indemnification

You agree to indemnify and hold harmless Top Speed AI, LLC, and its owners, employees, and contractors from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your use or misuse of the Service.

  • Your User Content or Generated Images.

  • Your violation of these Terms or any applicable law or rights of a third party.

9. Third‑party rights and content

The Service may use or reference historical photos or materials sourced from third parties.
Top Speed AI, LLC does not claim ownership of such third‑party materials and provides no warranty regarding their accuracy, authenticity, or legal status.
You are responsible for ensuring that your use of the Service complies with any applicable third‑party terms or rights.

10. Age requirement

The Service is intended for users aged 13 and older (or the minimum age required in your jurisdiction).
If you are under the age of majority in your jurisdiction, you may use the Service only with the consent of a parent or legal guardian.

11. Changes to the Service and terms

Top Speed AI, LLC may modify or discontinue the Service, or update these Terms, at any time.
If changes are material, we will make a reasonable effort to notify you (for example, via in‑app notice).
Your continued use of the Service after changes take effect means you accept the updated Terms.

12. Governing law and disputes

These Terms are governed by the laws of the State of Texas, without regard to its conflicts of law rules.
Any disputes arising out of or relating to the Service or these Terms will be resolved exclusively in the state or federal courts located in Collin County, Texas, and you consent to their jurisdiction.
